Communications Regulations Published

 

The new communications regulations have been published. Their publication follows a series of consultations between the Tanzania Communications Regulatory Authority (TCRA) and stakeholders. The new Regulations, covering various relevant aspects are:

  • Consumer Protection Regulations, 2005
  • Content Regulations, 2005
  • Dispute Resolution Regulations, 2005
  • Licensing Regulations, 2005
  • Importation and distribution Regulations, 2005
  • Infrastructure Sharing Regulations, 2005
  • Installation and Maintenance Regulations, 2005
  • Interconnection Regulations, 2005
  • Numbering and Electronic Address Regulations, 2005
  • Postal Regulations, 2005
  • Quality of Service Regulations
  • Radiocommunication and Frequency Spectrum Regulations, 2005
  • Tariff Regulations, 2005
  • Type Approval Regulations, 2005

 

Why new regulations?

 

There is no doubt that these regulations will be useful guidelines, noting that ICTs are evolving very rapidly. The current set of regulations was introduced in 2001.  ICTs are rapidly changing, as evidenced by the convergence of the phone, television and the pc. For this reason we need to adjust, alter, modify or reform our regulations, wherever possible, whenever necessary. The former regulations may have been appropriate in the traditional markets which emerged from the days of monopoly, but are not today, considering the environment which operates in a market which is governed by laws of competition and products of converged technologies.

About TCRA

 

The Tanzania Communications Regulatory Authority  (TCRA) is an independent government agency responsible for regulating the communications and broadcasting sectors in Tanzania. It was established under the Tanzania Communications Regulatory Authority Act No.12 of 2003  which merged the Tanzania Communications  Commission and the Tanzania Broadcasting Commission. TCRA  became operational on 1st November, 2003 and has effectively taken over the functions of the two defunct  commissions.  Specifically the Authority is responsible for enhancing the welfare of Tanzanians through:

 

  • Promotion of effective competition and economic efficiency;
  • Protecting the interests of consumers;
  • Promoting the availability of regulated services;
  • Licensing and enforcing licence conditions of broadcasting, postal and telecommunication operators.
  • Establishing standards for regulated goods and services
  • Regulating rates and charges (tariffs);
  • Managing the radio frequency spectrum;
  • Monitoring the performance of the regulated sectors;
  • Monitoring the implementation of ICT applications.
  • Managing numbering resources
